BS5837 Services

What is BS5837 and why do I need it for planning?

Trees are a key consideration in the planning process, and Local Planning Authorities (LPAs) often require a BS5837:2012 survey and report—'Trees in Relation to Design, Demolition and Construction Recommendations'  as part of their validation checklist.

Ancient woodlands and ancient and veteran trees receive significant protection under the National Planning Policy Framework (NPPF). LPA’s must assess the impact of development on ancient woodlands and ancient and veteran trees when reviewing planning applications. Restrictions or conditions may be imposed to safeguard these valuable natural assets.

If a tree, group of trees, or woodland is protected by a Tree Preservation Order (TPO), it is unlawful to carry out any work, or remove any part of the tree without prior consent from the LPA.

Trees within a conservation area not covered by a TPO are still protected under Section 211 of the Town and Country Planning Act 1990. In such cases, a Section 211 Notice must be submitted to the LPA at least six weeks before any work begins, unless an exception applies. The work may proceed sooner if the LPA grants consent, however this notice period allows the LPA to determine whether a TPO should be placed on the tree.
